Welcome to the OlyBet Sports Bar App (“the App”)

The App is operated jointly by:

• Kungla Investeeringu Osaühing, an Estonian company with registry code 10103126, with its office at Pronksi 19, 10124 Tallinn, Estonia
• Ahti SIA, a Latvian company with registry code 40003420708, with its office at Rēzeknes iela 5E, Rīga, LV-1073, Latvia; and
• Mecom Grupp UAB, a Lithuanian company with registry code 111733421, with its office at Konstitucijos pr. 12, Vilnius, Lithuania;

(hereinafter “we,” “us,” or “our”, or “Company”). These Terms & Conditions govern your access to and use of the App, including anycontent, functionality, and services offered on or through the App. By using the App, you agree to be bound by these Terms & Conditions. Please also read our Privacy Notice to understand how your personal data is processed when using the App.

The company with whom you are contracting with under these Terms of Conditions depends on the country where you are resident when registering the user account in the App as follows:

• residents of Estonia – Kungla Investeeringu Osaühing,
• residents of Latvia – AHTI SIA
• residents of Lithuania – Mecom Grupp UAB

If after registration you do not agree to these Terms & Conditions, please do not use the App. Your use of the App is considered as acceptance of these Terms and Conditions.

2. Purpose of the App
The OlyBet Sports Bar App is designed to provide users with information on:
• Sports Bar events
• Offers and promotions
• Personal discount code
• OlyBet Sports Bar locations in the Baltics (based on user preferred location)
• Personalized experiences based on user preferences

3. User Account
To access certain features, users must create an account. To create an account, you accept and agree to:
• be at least 18 years of age;
• provide and keep in the App accurate and up-to-date information;
• keep your login information secure and confidential;
• take full responsibility for all activities under your account;
• use the App only personally and only for personal purposes.

You may not:
• create more than one user account ;
• use the App in multiple devices and on devices which are not under your control;
• use the App in a manner that would bring the OlyBet Sports Bar trademark into disrepute;
• use the App for commercial purposes.

You must ensure that third parties do not have access to your device and the App. In case a third party logs into the App or uses the App using the valid email address and password of the user, it is regarded as your use of the App and you shall have no recourse against us in case of any damages.

We may immediately close any user account which breaches these conditions herein, or based on our unilateral business decision.

5. Discount Codes and Promotions
From time to time, we may offer discount codes, promotions, or special offers to users. These promotions are subject to specific terms, including expiration dates and usage limits, which will be provided at the time of the offer. Promotions may not be combined unless expressly stated otherwise.

6. Events and Offers
The App will display events and special offers hosted at various OlyBet sports bar locations across Estonia, Latvia and Lithuania. All events and offers are subject to availability and may change without prior notice. We are not responsible for any costs or losses resulting from the cancellation or modification of any event or offer.

7. Limitation of Liability
You accept that Your use of the App is on your sole responsibility, and since the App is software-based, then the App is offered on an “as is” basis and we do not warrant that the App is accessible and in working order 24/7 or fit for any particular purpose, and to the fullest extent permitted by applicable law, we will not be liable for any damages resulting from your use of the App, including but not limited to direct and indirect damages and pecuniary and non-pecuniary damages.

8. Intellectual Property
By downloading and using the App, you are granted a limited, non-exclusive, royalty-free, worldwide, non-transferable, non-assignable, non-sublicensable license to download and install the App on your device and to use it for the purposes listed herein. The license is subject to all terms and conditions herein.
All content, features, and functionality of the App, including text, graphics, logos, and images, are owned by and/or licensed to us and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the App without our prior written permission and you will indemnify us in full in case you breach this obligation.

9. Modifications to Terms
We may unilaterally modify these Terms & Conditions at any time. If changes are made, we will notify users by updating the “Last updated” date at the top of this page, as well as provide a popup in the App where you are asked to accept the new Terms & Conditions. Your continued use of the App following any changes or the popup is regarded as your acceptance of the modified terms.

10. Applicable law and jurisdiction
In case of disputes, the applicable law to these Terms & Conditions is the law of the Republic of Estonia and any litigation or legal proceedings shall be brought before Harju County Court located in Tallinn, Estonia.
